19. Insurance Compliance and Liability Policy
(Florida Statutory Framework and Applicable Insurance Standards)
This Insurance and Liability Policy is established in accordance with the applicable laws and regulatory framework of the State of Florida, including but not limited to Florida Statutes Chapters 324 (Financial Responsibility Law), 627 (Insurance Rates and Contracts), and 642 (Motor Vehicle Service Agreements), as well as insurance market standards applied by Florida-licensed carriers and residual market entities such as Citizens Property Insurance Corporation when relevant as a benchmark for policy governance and documentation requirements.
1. Personal Insurance Eligibility and Mandatory Coverage Requirements Florida residents may elect to use their personal automobile insurance policies to cover rental vehicles; however, pursuant to the requirements of Florida Statutes Chapter 324 and standard underwriting rules applied by licensed insurers, coverage is only valid when:
• The policy explicitly includes rental vehicle coverage.
• The policy extends coverage to 12-passenger and 15-passenger vans, and to wheelchair-accessible or specialized mobility vehicles, which may be classified as commercial-use or high-capacity units subject to underwriting exceptions.
• No exclusions, restrictions, or coverage limitations apply to high-occupancy vehicles, rental vehicles, or temporary substitute vehicles. Insurance benefits provided by credit card companies cannot be accepted when the card issuer applies exclusions for high-capacity vans, commercial-type vehicles, accessible vehicles, or liability protections, as these exclusions constitute a denial of financial responsibility under the standards of Chapter 324 of the Florida Statutes. Should the client’s insurance or credit card coverage fail to meet the categories above, the acquisition of insurance offered by Florida Van Rentals becomes mandatory.
2. Client Assumption of Liability and Eviction of Rights If the client declines the insurance coverage provided by Florida Van Rentals, the client acknowledges and agrees that:
• They assume full civil and financial responsibility for any damages, losses, injuries, liabilities, or claims arising from the rental, including bodily injury, property damage, towing, storage, administrative fees, diminished value claims, and legal expenses.
• They certify, under penalty of misrepresentation, that their personal insurance coverage satisfies all statutory standards and that no exclusions apply.
• In accordance with the doctrine of eviction of rights, the client relinquishes any claim against Florida Van Rentals for lack of coverage and bears full responsibility for ensuring the adequacy of their insurance benefits. This provision aligns with contractual freedom principles recognized under Florida law and with financial responsibility requirements under Florida Statutes §§ 324.021 and 324.022.
3. Verification Obligations and Documentation Standards Before vehicle pickup, and in compliance with standard insurance verification practices observed by Florida-licensed carriers and endorsed by administrative frameworks similar to those used by Citizens Property Insurance Corporation, the client must:
• Connect their insurance policy using the verification link provided by Florida Van Rentals.
• Provide a valid, active, and nonexpired Declaration Page issued by their insurer.
• Ensure that policy limits and coverage types satisfy statutory requirements and underwriting standards for rental vehicles. Failure to provide proper documentation prior to vehicle release will result in:
• A penalty fee of 400 US dollars.
• Mandatory application and proportional billing of the insurance coverage provided directly by Florida Van Rentals for the duration of the rental.
4. Recordings and Evidentiary Use In accordance with Florida Statutes § 934.03(2)(d), Florida permits the recording of telephone calls with the consent of one party. All calls placed to or from Florida Van Rentals may be recorded and stored for purposes of training, operational quality control, fraud prevention, insurance verification, and legal protection. Such recordings may be used as evidence in administrative or judicial proceedings related to contractual compliance, insurance disputes, or liability assessment.
20. Airport Concession Fee Policy
At some airports, customers arriving by air may be required to pay airport concession fees in accordance with airport regulations.
If your rental involves airport pickup, drop-off, or services related to an airline arrival at these airports, a concession fee may apply. Fees are mandated by the airport authority and are subject to change.
Attorney’s Fees, Collection Costs, Insurance Requirement and Accident-Related Charges
Attorney’s Fees and Collection Costs:
In the event of non-payment, delinquency, breach of this Agreement, or the need to enforce any of its terms, the Renter agrees to be fully responsible for all costs of collection, enforcement, or recovery incurred by Florida Van Rentals Inc., including but not limited to reasonable attorney’s fees, court costs, collection agency fees, and any related legal expenses, whether or not litigation is initiated.
Accident-Related Expenses:
The Renter shall be fully responsible for all costs arising from or related to any accident, incident, damage, or loss involving the rented vehicle, including but not limited to repair costs, towing charges, impound fees, temporary storage or parking fees, administrative fees, diminished value, and loss of use (lost rental income) for the period during which the vehicle is unavailable for rent.
Insurance Requirement:
The Renter is required to provide valid and active proof of personal auto insurance, including the insurance declaration page, prior to vehicle pickup.
If proof of insurance is not provided before pickup, the Renter expressly agrees that Florida Van Rentals Inc.’s insurance coverage will be automatically added to the rental and charged to the Renter at the applicable rate, without exception.
No Waiver:
Failure by Florida Van Rentals Inc. to immediately enforce any provision of this clause shall not constitute a waiver of its right to do so at any time.
